Signed into law on July 22, 2021 and effective October 20, 2021, A-4250/S-2508 permanently authorizes online remote notarization, allowing notarizations to occur using widely available services like Zoom, Microsoft Teams, WebEx or even FaceTime.
Can attorneys do virtual will signings?
It appears that many attorneys who performed virtual will signings during the height of the pandemic are not likely to continue to do so as further social distancing restrictions are lifted, given the logistical issues and the amount of time the virtual will signings take.
Do you need a will to notarize a remote document?
However, for signatures on other documents that do not require the formalities of a will – such as the signing of deeds, renunciations, disclaimers and consents – remote notarizations will likely continue. In fact, remote notarization has been remarkably useful in having signatories in foreign countries have their documents acknowledged in a manner that complies with the requirements of the courts where the documents are to be filed.
